L’accompagnement de fin de vie est devenu une pratique usuelle, conseillée, en France, dans les établissements d’hébergement pour personnes âgées dépendantes. Il fait l’objet de formation continue et est inscrit dans les recommandations des sociétés de soins palliatifs. Mais l’accompagnement de fin de vie est-il un concept ? Une pratique ? Une fonction ? Qui sont les acteurs de cet accompagnement ? Est-ce une attribution des professionnels de santé ou de tout un chacun dans la société ? Nous tenterons, d’abord, (...) de cerner le concept d’accompagnement dans le champ des pratiques sociales. Nous verrons qu’il s’agit bien d’une pratique qui s’appuie sur des fondements théoriques du souci de l’autre, de la bienveillance, de l’être-avec. Puis la description sociohistorique de l’accompagnement et du soin palliatif nous montrera l’idéal humain qu’il recouvre. Cependant les valeurs communes à l’un et l’autre tendent à la confusion entre accompagnement de fin de vie et soin palliatif. C’est pourquoi certains auteurs nous invitent à une réflexion éthique sur l’accompagnement. Ils nous proposent de préciser la fonction et la posture professionnelle qu’il requiert. Enfin, nous verrons l’importance de délimiter le contexte dans lequel s’insère cette pratique. (shrink)

A major difficulty for currently existing theories of inductive inference involves the question of what to do when novel, unknown, or previously unsuspected phenomena occur. In this paper one particular instance of this difficulty is considered, the so-called sampling of species problem.The classical probabilistic theories of inductive inference due to Laplace, Johnson, de Finetti, and Carnap adopt a model of simple enumerative induction in which there are a prespecified number of types or species which may be observed. But, realistically, this (...) is often not the case. In 1838 the English mathematician Augustus De Morgan proposed a modification of the Laplacian model to accommodate situations where the possible types or species to be observed are not assumed to be known in advance; but he did not advance a justification for his solution. Authority qua empowerment is the weak reading of authority in Hans Kelsen's writings. On the one hand, this reading appears to be unresponsive to the problem of authority as we know it from the tradition. On the other hand, it squares with legal positivism. Is Kelsen a legal positivist?Not without qualification. For he defends a normativity thesis along with the separation thesis, and it is at any rate arguable that the normativity thesis mandates a stronger reading of authority than that (...) modelled on empowerment. I offer, in the paper, a prima facie case on behalf of a stronger reading of authority in Kelsen. I go on to argue, however, that the textual evidence weighs heavily in favour of the weak reading. Both nomostatics and nomodynamics are pervasive points of view in the Pure Theory of Law, and both reflect species of empowerment as the endpoint of Kelsen's reconstructions. (shrink)

Joachim Schulte’s introduction provides a distinctive and masterful account of the full range of Wittgenstein’s thought. It is concise but not compressed, substantive but not overloaded with developmental or technical detail, informed by the latest scholarship but not pedantic. Beginners will find it accessible and seasoned students of Wittgenstein will appreciate it for the illuminating overview it provides.

Many religious people are alarmed about features of the current age - violence in the media, a pervasive hedonism, a marginalization of religion, and widespread abortion. These concerns influence politics, but just as there should be a separation between church and state, so should there be a balance between religious commitments and secular arguments calling for social reforms. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

We discuss why, contrary to claims recently made by P.W. Anderson, decoherence has not solved the quantum measurement problem.

In this paper the authors argue that research ethics committees should not be paternalistic by rejecting research that poses risk to people competent to decide for themselves. However it is important they help to ensure valid consent is sought from potential recruits and protect vulnerable people who cannot look after their own best interests. The authors first describe the tragic deaths of Jesse Gelsinger and Ellen Roche. They then discuss the following claims to support their case: competent individuals are epistemologically (...) and ethically in the best position to say which risks are reasonable for them, so RECs should be no more restrictive than the “normal” constraints on people taking risks with themselves; RECs do not judge individual competence ; individual liberty is mostly limited by what serves the public interest, and RECs do not determine public interest; RECs may have a paternalistic role in preventing exploitation of competent people vulnerable to the use of incentives, and in protecting the interests of incompetent people; however, the moral and political authority of RECs has not been established in this respect. Inducing the rubber hand illusion (RHI) requires that participants look at an imitation hand while it is stroked in synchrony with their occluded biological hand. Previous explanations of the RHI have emphasized multisensory integration, and excluded higher cognitive functions. We investigated the relationship between the RHI and higher cognitive functions by experimentally testing task switch (as measured by switch cost) and mind wandering (as measured by SART score); we also included a questionnaire for attentional control that comprises two subscales, attention-shift (...) and attention-focus. To assess experience of RHI, the Botvinick and Cohen (1998) questionnaire was used and illusion onset time was recorded. Our results indicate that rapidity of onset reliably indicates illusion strength. Regression analysis revealed that participants evincing less switch cost and higher attention-shift scores had faster RHI onset times, and that those with higher attention-shift scores experienced the RHI more vividly. These results suggest that the multi-sensory hypothesis is not sufficient to explain the illusion: higher cognitive functions should be taken into account when explaining variation in the experience of ownership for the rubber hand. Theconnections of this issue with the distinction between context-drivenand theory-driven accounts of reference and essence are probed.Context-driven accounts tend to be less hospitable to eliminativism thantheory-driven accounts, but this tendency should not be overstated.However, since both types of account give essences explanatory depth,eliminativist claims associated with supposed impossible essences areproblematic on both types of account.Part 2 applies (...) these considerations to responsibility in particular. Objective: To identify factors that predict physicians’ intent to comply with the American Medical Association’s ethical guidelines on gifts from the pharmaceutical industry.Methods: A survey was designed and mailed in June 2004 to a random sample of 850 physicians in Florida, USA, excluding physicians with inactive licences, incomplete addresses, addresses in other states and pretest participants. Factor analysis extracted six factors: attitude towards following the guidelines, subjective norms , facilitating conditions , profession-specific precedents , individual-specific precedents and intent. Multivariate regression (...) modelling was conducted.Results: Surveys were received from 213 physicians representing all specialties, with a net response rate of 25.5%. 62% of respondents were aware of the guidelines; 50% had read them. 48% thought that following the guidelines would increase physicians’ credibility and professional image; 68% agreed that it was important to do so. Intent to comply was positively associated with attitude, subjective norms, facilitators and sponsorship of continuing medical education events, while individual-specific precedents had a negative relationship with intent to comply. Predictors of intent were attitude, subjective norms, the interaction term , sponsorship of CME events and individual-specific precedents.Conclusions: Physicians are more likely to follow the AMA guidelines if they have positive attitudes towards the guidelines, greater subjective norms, fewer expectations of CME sponsorship and fewer individual-specific precedents. Physicians believing that important individuals or organisations expect them to comply with the guidelines are more likely to express intent, despite having fewer beliefs that positive outcomes would result through compliance. The content of this alienation lies, on the one hand, in the idealist factoring-out of consciousness beyond the limits of being, of the real, the detachment of pure consciousness from real (...) man as the subject of consciousness, the de-ontologization of man, and, on the other hand, in the reduction of all the real, all being, purely to that which is tangible. What fundamental aim should be seen as animating egalitarian views of distributive justice? I want to challenge a certain answer to this question: namely, that the basic aim of egalitarianism is to neutralize the effects of luck on the distribution of goods in society. I shall also sketch part of a different answer, which I think does a better job of supporting egalitarianism.My arguments here are not presented in a way that is intended to win over those who have no (...) sympathy with egalitarianism to begin with; they move within the compass of egalitarian concern. Moreover, it is difficult, for familiar reasons, to separate the question of what the basic aim of egalitarianism is from the question of what it should be. If one aim does a better job of supporting egalitarian results than another, then, even if few egalitarians recognize this, it may be regarded as a stronger candidate for what the basic aim of egalitarianism is. As with other essentially contested concepts, a new conception does not change the subject. (shrink)
